The Madrid Protocol is an international treaty established to enhance the international registration system for trademarks. Administered by the World Intellectual Property Organization (WIPO), it enables trademark owners from participating countries to pursue registration in any of the countries that have ratified the Madrid Protocol. As of October 14, 2013, there are 92 member countries actively involved in this treaty.
In order to file an international application through the USPTO, the applicant must possess either a pending U.S. application (referred to as a "base application") or a U.S. registration (referred to as a "base registration"). The USPTO will validate the international application based on the information provided in the base application or registration. Once certified, the USPTO will transmit the international application to the International Bureau (IB) of WIPO. The IB will independently review the international application to ensure compliance with the filing requirements outlined in the Madrid Protocol.
If the international application passes the IB review, it will be published in the WIPO Gazette of International Marks. Subsequently, the IB will inform the member countries designated in the international application about the request for an extension of trademark protection. Each designated member country will then examine the application according to its own criteria. If the application meets the requirements of a particular country, that country will grant protection to the trademark.
An international registration remains valid for a period of 10 years starting from the date of registration and can be renewed for additional 10-year periods.
