A universal symbol refers to an image or design that effectively conveys information and carries a widely recognized meaning when combined with its relevant content. Examples of such symbols include the recycling symbol, biohazard symbol, and peace symbol. However, a universal symbol may not qualify as a trademark due to its primary function of communicating information, serving as decoration, or simply describing the goods or services' function, quality, feature, or purpose. Furthermore, if a universal symbol creates a false impression about the goods or services, it may be rejected as deceptive or deceptively misdescriptive. Thus, an Examining Attorney may refuse a trademark application that contains a universal symbol.
There are circumstances when a universal symbol can function as a trademark and be eligible for registration. For instance, if a universal symbol is highly stylized, incorporates atypical elements, or is intertwined with other elements of the mark, resulting in a distinctive commercial impression, it may be considered capable of registration. In such cases, a highly stylized pictorial representation of descriptive matter typically does not require a disclaimer statement since the design element itself creates a unique commercial impression.
The key question in determining whether a mark containing a universal symbol can be registered revolves around whether the mark would be perceived as an indicator of the source. The specimen plays a crucial role in this analysis, although its significance may be diminished if the Examining Attorney concludes that the mark can only function as informational matter. For instance, if the biohazard symbol appeared on containers specifically designed for medical waste disposal, it would serve solely to convey information regardless of how the mark is presented. Consequently, it would be unable to function as a source indicator or trademark. In such cases, the Examining Attorney would reject the application, providing evidence of the symbol's widely recognized meaning and demonstrating that it commonly appears on similar goods. If the mark is refused on these grounds, the applicant will not have the opportunity to demonstrate acquired distinctiveness or amend the application to the Supplemental Register.
