How long do I have to live in Texas before I can file for divorce?
You can file a divorce petition if:
- Either the petitioner or respondent has resided there for the past 90 days if both parties have been domiciled in Texas for the past six (6) months.
- The county where the Petitioner has resided for the past 90 days if he or she is the only party who has been domiciled in Texas for the past six (6) months; or
- The county where the Respondent resides if he is the only party who has been domiciled in Texas for the past six (6) months.

Is there a mandatory waiting period before a divorce can be granted?
There is a 60-day waiting period.
Generally, a court cannot render a final judgment for divorce until at least 60 days after the day the suit was filed. Tex. Fam. Code Sec. 6.702(a).
A party can ask for a waiver of the 60-day waiting period if:
(1) The Respondent has been convicted of or received deferred adjudication for an offense involving family violence against the Petitioner or a member of the Petitioner’s household; or
(2) The Petitioner has an active protective order and order based on finding of family violence committed by the Respondent during the marriage.
What are the specific forms I will need to file for a divorce in Dallas County?
A divorce generally requires two documents to initial it in Texas:
- a Petition for Divorce; and
- a Civil Case Information Sheet.
