When applying for a trademark, you are required to indicate the "basis" for filing your application. In the United States, most applicants select either their current use of the mark in commerce or their intention to use the mark in commerce in the future.
The "use-in-commerce" basis means that you are currently utilizing the mark in the sale or transportation of goods, or providing services that involve "interstate" commerce between more than one state or U.S. territory, or commerce between the U.S. and another country. For goods, the mark must be displayed on the actual goods, the packaging of the goods, or the marketing materials associated with the goods. In the case of services, the mark must be used in the promotion or sale of the services.
If you haven't started utilizing the mark but have intentions to use it in the future, you have the option to file your application based on a good faith intent to use the mark in commerce. This can include having a business plan, developing prototype products, or engaging in other preliminary business activities that demonstrate a genuine intention to use the mark.
