Why is it important to ensure that trademark Class 4 is correct before filing?
It's important to ensure that Trademark Class 4 is the right class, because if you get it wrong, you may not be able to register a trademark. And if you do manage to register for the wrong class, you can't change your registration to Trademark Class 4 later or switch from a good to a service. You must start the process over if you have the wrong class.

Likelihood of Confusion in a Trademark
The most common reason for refusal of registration is the "likelihood of confusion" between the applicant's mark and a previously registered mark or a pending application owned by another party. The USPTO considers marks to be similar and related goods and services to be the same if consumers would mistakenly believe they come from the same source. However, having similar marks or related goods/services alone is not enough to establish a likelihood of confusion, except in cases where the mark is already famous. In other words, two identical marks can coexist if they're not associated with related goods and services.
There's no fixed formula used to determine the likelihood of confusion, as each application is evaluated based on its unique circumstances. Therefore, it's crucial to conduct a comprehensive trademark search before submitting a non-refundable application to ensure that the proposed mark won't cause confusion with another mark.
