Parental Visitation and Child Custody


Under the Texas Family Code, it is believed that the best way to schedule time for the child to see each parent is the Texas Standard Possession Schedule. This was designed to provide stability for the child and ensure that both parents get ample amount of time with their child. Every child custody case is unique, and parents can agree to do something different that works for them.


hen parents can no longer co-parent amicably, their case will go to court for a custody determination. The judge will make a ruling based on your unique circumstances and Texas law. There are four areas to be addressed in child custody cases handled by a court:


  • Conservatorship
  • Rights and responsibilities
  • Parenting time/visitation
  • Child support

Standard Child Custody Possession During School Year

Weekends MidWeek

Elective Possession During School Year

1st, 3rd, and 5th weekends Pick up from school on Friday and drop off at school on Monday Every Thursday, pick up from school and drop off at school on Friday

Additional Child Custody Visitation

  • What is a Non-Custodial Parent's Spring Break in Texas?

    In even-numbered years, the non-custodial parent has the right to possession of the child during their spring vacation.

  • What is a Non-Custodial Parents Possession Rights Over 100 Miles?

    During the regular school year the non-custodial parent wants, they can have regular visitation as explained above or 


    - One weekend per month of their choosing; or

    - No Thursday visitation.


    Druing Spring Vacation, the Non-custodial parent gets the child for every spring break.


    For Summer Vacation, the Non-custodial parent has the right to have the child for 42 days during their summer break.


    Holidays are the same.

Parent has the child from the time school lets out for Thanksgiving break. Parent has the child from the time school lets out until noon on December 28th Parent has the child from December 28th at noon until 6PM on the day before school starts again.

How is Child Support Calculated in Texas?

In Texas, child support is calculated based on a set of guidelines that consider the income of the parents, the number of children, and the amount of time each parent spends with the children. The guidelines are intended to ensure that children receive a fair and consistent level of financial support, regardless of the parents’ income. 


The Texas child support laws provide the following calculations.


  • One child: 20% of net monthly income;
  • Two children: 25% of net monthly income;
  • Three children: 30% of net monthly income; and
  • Four children: 35% of net monthly income, so on and so forth.
